Statutory right of withdrawal

The following withdrawal instructions apply to consumers purchasing goods under distance contracts. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you other than the carrier, take possession of the goods. If you have ordered several items in a single order and they are delivered separately, the period begins upon receipt of the last item. If an item is delivered in several partial shipments or pieces, the period begins upon receipt of the last partial shipment or the last piece. In each case, the relevant date is the date of receipt by you or a third party designated by you other than the carrier.

To exercise your right of withdrawal, you must inform us (07eins GmbH, Willenbach 12, 84367 Reut, Germany, telephone: +49 8572-7909791, email: widerruf@07eins.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but this is not obligatory.

You may also exercise your right of withdrawal online at https://07eins.com/pages/widerrufsformular. You can also access this function via the “Declare withdrawal” link in the footer of our website. If you use this online function, we will send you an acknowledgement of receipt without delay on a durable medium (e.g. by email), containing information on the content of the withdrawal declaration and the date and time of its receipt.

The online function is an additional option. You may also exercise your right of withdrawal by another unequivocal statement, for example by letter, email or telephone.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we must reimburse all payments received from you, including delivery costs (except for the supplementary costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided evidence that you have sent the goods back, whichever is the earlier.

You must send back or hand over the goods to 07eins GmbH, Willenbach 12, 84367 Reut, Germany without delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days expires.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

Statutory exceptions

The right of withdrawal does not apply to contracts:

• for the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
• for the supply of goods that may deteriorate rapidly or whose expiry date would soon be exceeded;
• for the supply of alcoholic beverages whose price was agreed when the contract was concluded, but which can only be delivered at the earliest 30 days after the conclusion of the contract and whose current value depends on market fluctuations beyond the trader’s control;
• for the supply of newspapers, periodicals or magazines, except for subscription contracts.

The right of withdrawal expires early for contracts:

• for the supply of sealed goods that are unsuitable for return for health protection or hygiene reasons, if their seal was removed after delivery;
• for the supply of goods if, after delivery, they have been inseparably mixed with other items due to their nature;
• for the supply of audio or video recordings or computer software in sealed packaging, if the seal was removed after delivery.

Simply selecting an offered standard variant does not make an item a custom-made product. Opening ordinary packaging or installing a component does not, in itself, exclude the right of withdrawal. Any compensation for diminished value is subject to the conditions stated above.

Voluntary extension: 180 days from receipt of the goods

Beyond the statutory right of withdrawal, we voluntarily extend your withdrawal period to a total of 180 days from receipt of the goods. The rules on receipt of the goods described above apply to the start of this period. The conditions above concerning the exercise and effects of withdrawal and the specified exceptions also apply during the voluntary extension.

Your statutory right of withdrawal remains unrestricted. This applies in particular if a statutory withdrawal period begins later or runs for longer. More extensive commitments remain in force for contracts already concluded.

Returns, statutory warranty and complaints

Withdrawal is possible without giving a reason and does not require the goods to be defective. Voluntary returns agreed independently of the right of withdrawal are subject to the conditions promised in each case.

Your statutory rights in respect of defective goods (statutory warranty) remain unaffected by the withdrawal periods and the voluntary extension. You may submit a complaint about a defect to us independently of the withdrawal form, for example by email to info@07eins.com.
